THE ROCCI TREE TERMS AND CONDITIONS
General
Unless a specialist class, otherwise stated or previously agreed in writing; our sessions are for OVER 18s only.
If you are Pregnant or Postnatal our regular classes are not suitable for you, please contact us for more information as we do offer sessions that you can attend.
Ahimsa (friendliness, kindness, non-violence) is the first principle of yoga; please practise this with yourself as well as others, please listen and respect your body and mind. Your ability may vary from session to session depending on your state of well-being, fitness, tiredness and/or stress levels. Work in a way that feels right for you on any given day. Pain is the body’s warning system and should not be ignored.
All of The Rocci Tree teachers are fully trained and insured to provide the best and safest teaching. Even with this it is important that you take responsibility for your own wellbeing. Our teachers are not medically trained and are therefore not qualified to assess whether you are in good physical condition and/or that you can engage in our sessions without detriment to your health, safety, comfort or physical condition. Please do extend, modify or rest when you need to, but please do not ‘do your own thing’ in our classes. We can hire you a space if you want to practise without instruction. Our sessions may involve hands-on adjustments; if you do not want hands-on adjustments, please notify your teacher or contact us prior to your session.
Please let the teacher know about any changes to your health (injury, illness, pregnancy etc) before the class begins. Most issues can be adapted for with enough prior warning, so please give as much notice for this as you can. Also, please let us know if you feel any discomfort during a session or if you felt any discomfort after a previous session.
If you have concerns over your physical condition, you are advised not to undertake any physical activities without first seeking medical advice.
The teacher can accept no liability for personal injury related to participation in a session if:
· Your doctor has, on health grounds, advised you against such exercise.
· You fail to observe instructions on safety or technique.
· Such injury is caused by the negligence of another participant in the class/studio.
We respect your privacy and personal information, and will not share it with anyone else. We may use your email address to send our informative email newsletters and other announcements, however should you wish to be removed from our mailing list at any time, you can opt out of email contact by logging in to your Momence account with your username and password and clicking through to My Account, or by emailing us on admin@theroccitree.co.uk
In the event of a fire, clients are asked to make their way to the nearest available exit.
Smoking is not allowed in any hall.
The Rocci Tree is not liable for any loss, damage or theft of any property (including bicycles) belonging to students of The Rocci Tree at any of our venues.
It is requested that you inform us of any change of address, email address and credit/debit card details that will affect the ability to collect payment when appropriate.
Non Attendance, Late Attendance and Late Cancellations
If you do not attend a booked class or cancel with less than two hours’ notice you will still be charged for the class. If you cancel before this time a credit will be automatically returned to your pass. (If you paid for the class as a separate purchase you will need to contact us to receive your credit.)
Please arrive at the studio 10 minutes before your class starts. Late arrivals will not be let in after the class has started and if the class is fully booked your space may be opened up to those on the waiting list. The Rocci Tree reserves the right to refuse entry.
Sometimes classes will be covered by other teachers we will endeavour to let you know when this will happen, but refunds will not be given in these circumstances.
Class Pass Validity Dates
Single Class Pass – valid for 1 month from the date of purchase.
5 Class Pass – valid for 2 months from the clients first visit.
10 Class Pass – valid for 4 months from the clients first visit.
20 Class Pass– valid for 6 months from the clients first visit.
Annual Memberships
Each of our Annual Memberships are non-refundable and for a 12-month minimum term.
Payment is by automatic card transaction on the same day of each calendar month. If it becomes necessary to do so, the day of the month can be changed after the membership has begun.
“Late cancel” and “no show” reservations will be charged at the drop-in rate for that class.
Early cancellations are subject to a cancellation fee and require 30 days written notice.
Early cancellation fees are as follows:
· Unlimited Membership £125
· 5 Class Membership £75
· 3 Class Membership £55
There are no cancellation fees for cancellations made after the first 12-month term is complete.
The membership and monthly payments will continue to auto-renew unless written notice is given at least 30 days prior to the end of the 12-month term.
One 30 consecutive day suspension allowance can be given within a 12-month period, following 10 days written notice.
Transfer your credit
All our passes and annual memberships are fully transferable to another person. This must be fully agreed by both parties and The Rocci Tree in advance.
All class passes and gift vouchers sold by The Rocci Tree are exchangeable to Pregnancy or Parent and Baby classes.
Expired Passes
In the event that your pass should expire with unused credit left on it you can extend it by contacting us, the admin fee for extensions is £5 for a 5-class pass, £10 for a 10-class pass and £20 for a 20-class pass. You will receive a week for each credit that is remaining unless otherwise agreed.
Course and Workshop Enrolments
Pre-payment in full is required at time of registration.
Refunds for cancellations are available up to seven days prior to the start date of course, minus a 10% processing fee.
No refunds are given less than seven days prior to the start of the course.
If The Rocci Tree cancels a course, a full credit or refund will be issued.
One cancellation per course is allowed for MUMMY & ME SENSORY YOGA, BABY YOGA and EARLY DAYS BABY MASSAGE. A credit will only be issued if cancellation is made via email prior to the session.
Family Yoga
Please note that children must be accompanied by a participating adult.
Photographic Permission
The Rocci Tree students consent to having their photograph taken by The Rocci Tree at any time whilst attending class and The Rocci Tree reserves the right to use any such individual or group photographs for press or promotional purposes. If a student specifically does not want their photograph used for such purposes, then they must notify The Rocci Tree in writing.
Ways we protect your information:
Systems are password protected and professionally administered.
We only allow ourselves access to our systems.
The computers on which we store information are kept secure by a number of different measures, by a professional hosting company.
We take all reasonable precautions to protect your information, but data can never be guaranteed 100% secure.
If our systems are compromised in some way, before data is removed then data may be revealed but thankfully, such an event is generally considered highly unlikely.
Please note that we will not be held liable for any breach of security unless we have been proved negligent.

THE ROCCI TREE YOGA TEACHER TRAINING TERMS AND CONDITIONS
By applying for a teacher training programme with The Rocci Tree, you agree with and will abide by the following terms and conditions:
1. Booking procedure, cancellation & refund policy
(a) On submission of your application form and payment of your deposit, we will contact you to process your application within 14 days. Further information or a phone interview may be required.
(b) All payments made are non-refundable. A refund of the deposit will only be issued if you are not accepted onto the programme.
(c) It is not possible at any stage to transfer your booking to another programme or service, nor is it possible to transfer your booking for use by another student.
(d) Should you be unable to attend the programme due to severe illness, injury, or pregnancy, you will be able to transfer onto a future teacher training programme if sufficient evidence from your GP or other registered doctor is provided.
(e) We reserve the right to reduce the price of the programme or run special offers at any time. Once you have made your application and paid your deposit, any subsequent price changes will not apply to you.
(f) In the unlikely event that the programme is cancelled or changed, you will be able to transfer onto a future training course. There will be no refund or compensation available from us for any related costs you may have incurred such as flights and accommodation.
(g) Compensation will not be paid if we are forced to cancel or in any way change your programme due to war, threat of war, invasion, riot, civil war, strike, rebellion, revolution, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions, technical or maintenance problems with transport, or other circumstances which amount to force nature.
(h) Trainees must have been practising yoga for a minimum of 2 years before they can be accepted onto The Rocci Tree Yoga Teacher Training Course.
(i) Your Certificate of Completion will not be given until the course has been paid for in full
Additional costs
(a) You will be expected to purchase (or otherwise acquire) items on The Rocci Tree reading list at your own cost in preparation for the programme. An approximate total cost of £80. The reading list will be supplied to you upon being accepted onto the programme.
(b) You will need to organise trainee yoga teacher public liability insurance at your own cost (we will discuss this during the first week of the programme). The price of this can vary but in the past has been around £30. Students enrolled onto a Foundation Training Course (200 hours) that is registered with Yoga Alliance Professionals can be registered with YAP as a Trainee Teacher. YAP can also provide insurance if you are based in the UK or Ireland and this will cover them for the duration of the course. Upon graduation, you can pay to upgrade to an Associate Level 1 membership.
(c ) You will be expected to fund Travel to and from training venues.
3. Assessment criteria and attendance policy
(a) To receive your 200 hour teacher training qualification, you must meet the following criteria:
· 100% attendance and participation in all sessions
· You must produce a minimum of 20 yoga cards over the course, these will be then be assessed to ascertain your knowledge of the practise.
· Pass a final practical teaching exam.
(b) Should make-up sessions be required due to missed sessions or not meeting the course standards, our trainers can provide agreed extra sessions at an additional cost.
4. Changes to programme
(a) It is unlikely that we will have to make any changes to your programme, but arrangements are made many months in advance and changes may have to be made. We reserve the right to, within reason, change any information advertised at any time, to include, but not be limited to, dates, times, content, location, and trainers. We will advise you of any changes at the earliest possible date.
5. Insurance and health
(a) It is your responsibility to inform The Rocci Tree of any injury/medical conditions or anything else that may impact your programme, when applying, before the programme and before the start of every session. If you have any health concerns, it is advisable that you consult a doctor or physician before attending the programme to ensure you are sufficiently fit and healthy to undertake the programme.
(b) If you experience any injury or discomfort during any activity organised for you, you must stop immediately and advise the trainer(s) accordingly.
(c) Due to the nature of yoga we are unable to accept pregnant women on our programme. If you are pregnant or are planning to be pregnant during the programme, please contact us before applying.
(d) We reserve the right to stop your participation in any activity, at any time, if we consider that you are physically, mentally or emotionally unable to do so in a safe way.
6. Liability waiver
(a) By applying for and attending a teacher training course with The Rocci Tree you accept and will abide by the following release of liability:
'I understand that, while the utmost care is taken, neither the individual trainers, the venue, nor The Rocci Tree Limited, will be liable for any damage or injury resulting from my practice or use of the programme venue, nor any loss or damage to personal belongings. I understand that sessions may be physically strenuous and may challenge me mentally and emotionally, and I voluntarily participate in them with the knowledge that there is risk of personal injury, mental health issues, property loss or death. I recognise that it is my responsibility to notify the trainer of any illness or injury before the start of every session and I will not perform any posture to the extent of strain or pain. I understand that should I not want physical adjustment in class it is my responsibility to inform the trainer before the start of every session. I agree that neither I, my heirs, assigns or legal representatives will sue or make any other claims of any kind whatsoever against The Rocci Tree, its trainers or its clients for any injury, property loss, or wrongful death, whether caused by negligence or otherwise.'
(b) The release of liability statement applies to the duration of the programme and every session or activity you participate in, whether in a group or private setting.
7. Media capture
(a) We may capture photo and video content throughout the programme which may be used for purposes to include but not be limited to our website and advertising material. By agreeing with these terms and conditions you grant The Rocci Tree full permission of the use of this media.
8. Alcohol and drugs policy
(a) You should not attend any session of the programme under the influence of alcohol or drugs, and doing so will result in immediate dismissal from the programme with no refund being issued.
9. Right to refuse
(a) We reserve the right to dismiss or refuse entry to any session of the programme at any time at the trainer's discretion with no refund being issued in the event of a breach of any of these terms and conditions, or due to disruptive or abusive behaviour.
10. No guarantee of work with The Rocci Tree
(a) We cannot guarantee employment with The Rocci Tree at the end of the programme.
11. Privacy policy
(a) Your application and any other contact you make with us, will be dealt with confidentially and only shared with The Rocci Tree programme trainers and its supporting staff.
12. Confidentiality
(a) During the programme you will share and hear Confidential Information. This term includes personal information shared by other participants on the course, and you shall hold all such information in confidence, and not disclose it or permit it to be made available to any other party without the prior written consent of The Rocci Tree.
13. Complaints
(a) If you have a problem during your programme, please inform a member of our team immediately, who will endeavour to put things right. Please note that we cannot be responsible for the individual behaviour of any other group member.
14. GDPR
As a student of The Rocci Tree training course, I consent to my contact details (name, email and phone number) being passed onto our partners, Yoga Alliance Professionals, so they can contact me directly and invite me to register as a Trainee and Teacher. I understand that I have the option of opting out of this registration process.
Any personal information will be destroyed after completion of the course apart from information we need to keep for legal reasons.
14. Subject to Change
These Terms and conditions are subject to change at any time.

RETREAT TERMS & CONDITIONS
1. Terms of agreement
(a) By booking and attending a retreat with The Rocci Tree, you are agreeing to comply with and be bound by the following terms and conditions.
(b) The term ‘The Rocci Tree’ or 'TRT' or ‘us’ or ‘we’ refers to the owner(s) of the company and it’s teachers - whose registered office is 10 Richmond Road, Leighton Buzzard, Bedfordshire, LU7 4RB. The term ‘you’ or 'I' refers to the student or guest of our retreat services. The terms 'retreat' or 'program' refers to all aspects of the services on offer, to include, but not be limited to, the classes, accommodation and activities.
2. Booking procedure
(a) Your place on the retreat is not confirmed until the deposit payment has been received. The remaining balance should be paid according to your payment schedule agreed by both parties. If the balance price of your retreat is not paid in time, we reserve the right to cancel your retreat and retain your deposit.
(b) If making your booking within 6 weeks from the retreat start date, the full balance will be due.
(c) Subject to clause 2(d), all payments are non-refundable. This includes deposit, remaining and full payments.
(d) A refund will only be issued if someone else can fill your space. A refund in this case is minus a cancellation charge of £50. Any monies owed in this case will be paid to you one month after the retreat end date.
(e) We reserve the right to reduce the price of the retreat or run special offers at any time. Once you have made your booking and paid your deposit these price changes will not apply to you.
(f) Membership discounts with The Rocci Tree classes do not apply to retreats as stated in your membership terms and conditions.
(g) Optional trips and treatments booked locally are not our responsibility and are at your own risk and cost.
3. Cancellation policy
(a) As stated in section 2(c) all payments are non-refundable. For this reason, we strongly recommend that you take out travel insurance to cover you in the event of any need to cancel at the last minute.
(b) Once the retreat has commenced, no refund or part refund or unused portion of your retreat will be repaid in the event of cancellation by you.
(c) In the very unlikely event that the retreat is cancelled by either party, there will be no refund or compensation available from us for your travel and other associated costs.
(d) We reserve the right in any circumstances to cancel the retreat, in which case we will offer a refund in full of all monies paid (unless the reason for cancellation is force majeure, see clause 3(e)).
(e) Compensation will not be paid if we are forced to cancel or in any way change your retreat due to pandemic, war, threat of war, invasion, riot, civil war, strike, rebellion, revolution, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions, technical or maintenance problems with transport, or other circumstances which amount to force majeure.
(f) We reserve the right to charge a cancellation fee of £50 if a guest decides to cancel a retreat for any reason.
(g) It is not possible at any stage to transfer your booking to another retreat or service.
4. Changes to retreat
(a) We reserve the right to, within reason, change any information advertised at any time, to include, but not be limited to, dates, times, timetable, location, accommodation, yoga teachers and prices. We will advise you of any changes at the earliest possible date and aim to keep disruption to a minimum.
5. Surcharges
(a) Unless stated otherwise, transportation costs to include, but not be limited to, flights, transfers and taxis, are not included in the price of the retreat.
6. Insurance and health
(a) It is the guest's responsibility to inform the teacher of any injury/medical conditions when booking and before the start of every session. If you have any injury/medical condition it is advised to consult a doctor or physician before attending the retreat to ensure you are sufficiently fit and healthy to undertake yoga classes and any other activity that has been arranged.
(b) If you experience any injury or discomfort during any activity organised for you, you must stop immediately and advise the teacher(s) accordingly.
(c) Should you be pregnant or are planning to be pregnant at the time of the retreat, please contact us to discuss before booking.
(d) We recommend all guests take up full travel insurance to cover medical expenses and personal belongings and should cover the type of physical exercise that will be undertaken. We hold no responsibility for illness, injury, death or loss or damage to personal belongings at any time (as per the liability waiver in section 7), nor will any compensation be issued in such case.
(e) We reserve the right to stop your participation in any activity, at any time, if we conclude that you are physically, mentally or emotionally unable to do so.
7. Liability waiver
(a) It is a requirement of anyone attending a retreat and/or classes with The Rocci Tree to accept and abide by the following release of liability:
'I understand that, while the utmost care is taken, neither the individual teachers, The Rocci Tree, nor the venue will be liable for any damage or injury resulting from my practice or use of the retreat centre, nor any loss or damage to personal belongings. I understand that classes may be physically strenuous, and I voluntarily participate in them with the knowledge that there is risk of personal injury, property loss or death. I recognise that it is my responsibility to notify the teacher of any illness or injury before the start of every yoga session and I will not perform any posture to the extent of strain or pain. I will notify the teacher before every class should I not want to be physically adjusted. I agree that neither I, or my legal representatives will sue or make any other claims of any kind whatsoever against The Rocci Tree or it's teachers for any injury, property loss.'
(b) The release of liability waiver applies to the duration of the retreat and every yoga session or activity you participate in, whether in a group or private setting. If this statement is not accepted, your booking will be terminated, and any monies paid in advance will not be refunded.
8. Alcohol / drugs policy
(a) Guests should not practise yoga under the influence of alcohol, drugs, or both, and doing so will result in immediate dismissal from the session, retreat, or both, with no refund being issued.
9. Right to refuse
(a) We reserve the right to dismiss or refuse entry to any session or the retreat at any time at the teacher's discretion with no refund being issued, in the event of breach of any of these terms and conditions, or disruptive behaviour.
10. Privacy policy
(a) We will not pass on your information to any third party or organisation outside of The Rocci Tree, without your permission. We respect your privacy.
(b) We will use your details to inform you of updates about the retreat and any future events. You can unsubscribe at any time contacting us via email.
11. Complaints
(a) If you have a problem during your retreat, please inform a member of our team immediately, who will endeavour to put things right. If your complaint cannot be resolved locally, you must advise us in writing on your return. Please note that we cannot guarantee the proportion of male/female in any group, nor be responsible for the individual behaviour of any group member or other guest on your retreat.

In addition, certain technologies we use may automatically collect certain information to help us administer, protect, improve our Services and improve users’ experience. We share personal information with others only as described in this Statement, or when we believe that the law permits or requires it.
Occasionally we collect and process what may be considered sensitive personal information.
Sensitive personal information is a subset of personal information and is generally defined as any information related to racial/ethnic origin, political opinions, religious beliefs, trade union membership, physical or mental health, and other medical information including biometric and genetic data, or sexual life or preferences. In some instances, sensitive personal information may also include precise geolocation information, financial and bank account numbers.
How we use personal information
We process personal information for these Services and business related purposes
• Account setup and administration: We use personal information such as your name, email address,
phone number and location to verify your identity, send Service information and newsletters.
• Marketing and events: We use personal information to deliver marketing and event communications to
you across various platforms, such as email, telephone, text messaging, direct mail, and online. If we send you a marketing email, it will include instructions on how to opt in to continue receiving these emails in the future.
• Hosted services: Any information stored by or on behalf of our customers is controlled and managed by
and only made accessible by The Rocci Tree Limited personnel with a critical business reason.
• Legal obligations: We may be required to use and retain personal information for legal and compliance
reasons, such as the prevention, detection, or investigation of a crime; loss prevention; or fraud. We may also use personal information to meet our internal and external audit requirements, information security purposes, and as we otherwise believe to be necessary or appropriate: (a) under applicable law; (b) to respond to requests from courts, law enforcement agencies, regulatory agencies, and other public and government authorities; (c) to enforce our terms and conditions; and (d) to protect our rights, privacy, safety, or property, or those of other persons.
When we share personal information
The Rocci Tree Limited shares or discloses personal information when necessary to provide Services or conduct our business operations as described below. When we share personal information, we do so in accordance with data privacy and security requirements. Below are the parties with whom we may share personal information and why.
• Within The Rocci Tree Limited personal information will be made available to personnel if necessary for
the provision of Services. All of our employees and contractors are required to follow our data privacy and security policies when handling personal information.
• Our third-party service providers: We partner with and are supported by service providers in the United Kingdom. Personal information will be made available to these parties only when necessary to fulfill the services they provide to us, such as direct marketing services and cloud hosting services. Our thirdparty service providers are not permitted to share or use personal information we make available to them for any other purpose than to provide services to us.
• Third parties for legal reasons: We will share personal information when we believe it is required, such
as:
▪ To comply with legal obligations and respond to requests from government agencies, including law enforcement and other public authorities, which may include such authorities outside your country of residence.

Where we store and process personal information
The Rocci Tree Limited is a UK organisation, and we take steps to ensure that the information we collect is processed according to this Privacy Statement and the requirements of applicable law wherever the data is located.
The Rocci Tree Limited has networks, databases, and systems, located at our office in the UK. We collaborate with third parties such as cloud hosting services, suppliers, and technology support located in the EU and USA to serve the needs of our business, workforce, and customers.
Please be aware that the cloud services providers we use to process and stored data are US based companies (Wellness Living and DropBox), their servers are located In the United States and this may be deemed as data transfer outside of the EU. The United States may not necessarily have data protection laws as comprehensive or protective as those in the EU: however, our collection, processing and storage of your Personal Data will at all times continue to be governed by GDPR and this Privacy Policy via the EU-US Privacy Shield, which both companies are certified for and will be compliant with GDPR requirements.
We take appropriate steps to ensure that personal information is processed, secured, and transferred according to applicable law.
How we secure personal information
The Rocci Tree Limited takes data security seriously, and we use appropriate technologies and procedures to protect personal information. Our information security policies and procedures are closely aligned with widely accepted international standards and are reviewed regularly and updated as necessary to meet our business needs, changes in technology and regulatory requirements.

• We have measures in place to protect against accidental loss and unauthorised access, use, destruction or disclosure of data.
• We have a Business Continuity and Disaster Recovery strategy that is designed to safeguard the continuity of our service to our clients and to protect our people and assets.

• We implement appropriate measures and controls, including monitoring and physical measures, to store and transfer data securely.
Training for employees and contractors
• We conduct privacy, information security, and other applicable training on a regular basis for our employees and contractors who have access to personal information and other sensitive data.
• We take steps to ensure that our employees and contractors operate in accordance with our information security policies and procedures and any applicable contractual conditions.
• We require, through the use of contracts, non-disclosure agreements and security reviews, our thirdparty vendors and providers to protect any personal information with which they are entrusted in accordance with our security policies and procedures.
How long we keep personal information
The Rocci Tree Limited retains personal information for as long as we reasonably require it for legal or business purposes. In determining data retention periods, The Rocci Tree Limited takes into consideration UK laws, contractual obligations, and the expectations and requirements of our customers.
